Summary
“Fallacy” opens at a crowded apartment party, where 19-year-old Cheryl Avery bursts out of a locked bathroom with a bloody hand and says Joe Cappilla tried to rape her. Joe, hit on the head with a vase, dies on the way to the hospital, and Cheryl slips out of the ambulance and gives police a false address. Joe’s brother, Eddie, is Cheryl’s boyfriend; he says he went home early after a fight with Joe because of a heart condition. Once found, Cheryl describes Joe groping and punching her, and Cabot leans toward calling the death justified. But a medic recalls Joe blaming Eddie, and Eddie’s sprained ankle turns out to come from a jump out the bathroom window. He admits he came back and found Joe already on the floor.
Blood evidence then shows that Cheryl is a transgender woman who has not had surgery. Eddie never knew, and when he is told he attacks her at the precinct. Cheryl admits she struck Joe as he was walking out, because he had threatened to tell Eddie. Eddie then swallows his heart medication at the station and dies, and IAB Sgt. Ed Tucker opens an inquiry into Cragen’s supervision of Stabler and Huang. Defense attorney Morton Berger takes Cheryl’s case and builds a self-defense claim on the violence she has faced all her life. Her parents admit throwing her out as a teenager; her younger sister, Sarah, says Cheryl was beaten repeatedly at school and only ever fought back. Huang concludes she did not intend to kill, and Cabot offers manslaughter.
Berger never passes the offer on, so Cabot tells Cheryl herself, and Cheryl pleads guilty, only to be housed with men because the state classifies her by anatomy. A judge offers just two options, stopping her hormones or protective custody, and the plea is set aside for a trial. Cabot asks DA Arthur Branch to reassign the case, but he urges her to keep it. In court a psychiatrist describes brain research on transgender women, and Cheryl recounts years of assaults, but under cross-examination she admits no one at the party knew her secret and that she had to stop Joe from reaching Eddie.
Spoiler, the ending: The jury finds Cheryl guilty of second-degree murder, and she begs not to be sent to a men’s prison. Afterward Cabot asks Benson whether she pushed too hard. Then Benson is called to Bellevue, where Cheryl is being taken into surgery after being gang-raped at Rikers Island.
