Summary
The Investigation
“Mother’s Day” opens with a hit-and-run in Washington Heights: Emily Milius, a 16-year-old from an exclusive Park Avenue girls’ school, is struck as she leaves a diner where she had waited for someone, and tire marks show the car sped up to hit her. Her mother, Caroline, thought she was with a friend in Gramercy Park. Classmates mention past ecstasy use, a failing chemistry grade and a college boyfriend her father disliked.
Her father, Ronald, a pharmaceutical company’s chief financial officer, privately admits he is helping federal investigators probe his firm’s executives and fears Emily was killed to silence him. The car, a green Saturn found abandoned, belongs to Diane Payton, who says her son Danny had borrowed it. The detectives find Danny stabbed to death in his apartment, its windows left open so that body temperature cannot fix the time of death.
Danny’s boss describes erratic behavior, and the medical examiner counts seven stab wounds, two of them hesitation wounds, with no defensive injuries. Danny’s stopped self-winding watch shows he died the night before the breakfast Diane says they shared. After the detectives push Diane hard, Van Buren takes over, talks with her about raising children, and Diane admits she killed her son.
The Trial
Kay Hartley, a corporate lawyer and Southerlyn’s law school classmate, fails to suppress the confession, then reveals Diane is her aunt and says Danny heard voices, turned violent and ran Emily down for no reason. Southerlyn helps her by getting Diane removed as administrator of Danny’s estate so his medical privilege can be waived. His psychiatrist, Dr. David Trask, says Danny never abused his mother, which sinks self-defense, but Hartley switches to defense of others, and the judge leaves it to the jury.
Van Buren testifies about the confession. Hartley ties Danny’s boot size to an unsolved kicking death and draws out that Diane had asked Trask to readmit Danny after he quit his medication. Branch urges a plea, but McCoy presses on. Diane testifies that Danny borrowed her car, contradicting Hartley’s claim that he stole the keys, and McCoy asks why she lent it to a son hearing voices. McCoy suspects Hartley wanted Diane to say otherwise to dodge reckless endangerment, and he tells Diane her niece concealed a plea offer.
Spoiler, the ending: In closing, Hartley calls Diane’s act a sacrifice for the greater good, while McCoy notes she never told the police or Danny’s doctors what he had done. The jury convicts Diane of second-degree murder, then asks whether she must go to prison; the judge says the law requires it. Afterward, the prosecutors observe that Diane seems to be the one person who wants her locked up.
