Premise: Carisi’s sister’s fiancé, a parolee, accuses his female parole officer of raping him at gunpoint, and Barba must persuade jurors that a man can be raped by a woman.

Summary

“Parole Violations” begins as Carisi’s pregnant sister, Bella, shows him the nursery she is planning with her fiancé, Tommy Sullivan, a parolee who has just been promoted at his moving company. That afternoon Tommy’s parole officer, Donna Marshall, keeps him waiting for hours and orders a urine test in her office. The next morning Bella turns up at the squad room because Tommy never came home. Carisi finds him arrested after a drunken bar fight, and Tommy says Marshall pulled her gun and coerced him into sex. Carisi is skeptical, but Benson treats it as a possible rape, since a parolee in an officer’s custody cannot legally consent.

Benson and Amaro persuade a reluctant Tommy to be tested and to hand over his clothes, and Carisi is kept off the case. Marshall’s supervisor, Ralph Kessel, jokes about the complaint when the squad interviews him. That night Marshall leads a surprise home visit, finds bagged oxycodone in the apartment and has Tommy arrested; he says she planted it after learning of his accusation. Bella, who learned of the encounter just before the raid, is furious and talks of moving back in with their parents. Marshall’s DNA turns up on Tommy’s clothes, and with her lawyer, Mickey D’Angelo, she admits the sex but insists Tommy started it and could not have performed under threat. Touch DNA on the pills belongs to another of her parolees, Jordan Dolphy, who says she faked his drug tests with vinegar in exchange for sex, once pulled a gun on him and made him hand over the oxycodone.

Barba admits he has never prosecuted a woman for raping a man, and Benson explains to Bella that a physical response is not consent. At trial, D’Angelo suggests that Tommy only claimed rape after SVU detectives told him he was a victim, and Tommy describes being handcuffed to Marshall’s desk at gunpoint. Then Dolphy slips out of the courthouse and returns as a defense witness, saying the police coerced him and that he sold Tommy the drugs himself. Barba exposes fresh needle marks on his arm, asks how he passed three years of urine tests and suggests that Kessel put him up to it.

Spoiler, the ending: Rather than testify, Marshall pleads guilty to evidence tampering and sexual misconduct, after an outburst about parolees who never change. She avoids prison but loses her job, receives probation and must register as a sex offender, and Kessel is to be investigated. The drug charges against Tommy are dropped, Carisi tells Bella that Tommy testified for her and the baby, and the couple reunite.
