Summary
“Institutional Fail” opens as Deputy Chief Dodds tells Benson she has passed the lieutenant’s exam, and she is called to a precinct where a small boy has walked in alone. He gives only his first name, Bruno, and Dr. Darby Wilder finds him filthy and neglected but not abused. Neighbors say his mother, Manuela, is often high. Overloaded Child Services caseworker Keith Musio identifies Bruno Ozuna and leads Benson and Carisi to the family’s apartment, where they find his eight-year-old half sister, Keisha Houston, starved and barely alive in a cage. Manuela is arrested and blames Keisha for crying, and Keisha dies. Manuela later says that Bruno’s father, Felipe, moved in after prison in May and brought the cage, that he was later shot dead, and that she has not seen a caseworker since Easter.
Musio’s report claims he found both children healthy two weeks earlier, but an analysis of his paperwork shows he stopped visiting about four months before, and nine Ozuna reports were scanned in the morning after Keisha died and approved by his supervisor, Janette Grayson. At headquarters, Deputy Commissioner Hank Abraham, backed by Dodds, tells Benson to leave it to the city’s investigators, but Barba, who does not answer to the NYPD, announces charges including second-degree manslaughter against Musio, Grayson and Deputy Commissioner Matt Sheridan. Judge Serani sets bail at $50,000 each. Rollins quietly warns Musio that he will take the fall, and dozens of other caseworkers’ reports turn out to have been filed that same morning. Dodds warns Benson off Barba and puts the pregnant Rollins on desk duty, and Musio agrees to testify that Grayson and Sheridan made him spend that Saturday backdating false reports for half the staff.
At trial, Wilder says Keisha’s decline took months and any visitor would have noticed it, and union lawyer Mickey D’Angelo likens the case to a doctor’s triage call. Musio testifies, and Manuela, sentenced to eight years, sees Bruno, who has been placed with a new family. Under Barba’s cross-examination Grayson denies knowing of any false files until he lists other cases, including a girl cleared on the day she reached the hospital covered in cigarette burns, and she breaks down, raging at the court and at Sheridan over the quotas she was told to meet.
Spoiler, the ending: Grayson is hospitalized at Bellevue and will plead guilty to manslaughter, Sheridan will serve a year, the agency’s commissioner steps down and an outside board is named to change its culture. Dodds then tells Benson her promotion has come through at a price: the department wants a sergeant under her it can trust, and he has picked his own son.
