Premise: A young lifeguard accuses the chief of the Bronx lifeguards of rape, and when he drowns on duty the squad uncovers how the chief qualified his staff.

Summary

“Breakwater” opens at a Bronx lifeguard qualifying test, where chief Paul Greco uses candidate Martina Rodriguez as his CPR model, then calls her into his office, says she missed the required time and offers to retrain her. Her brother Diego, 19, a lifeguard, sees her come out and attacks Greco. That night Diego is picked up drunk in a Midtown bar and tells Fin and Rollins that Greco raped him. Sober, he first takes it back, then explains that after his own test a year earlier Greco offered to retrain him and later forced him face down over his desk; afterward Diego got every post and overtime shift he wanted. Greco denies it, suggests Diego is on steroids and mentions that the young man is back at work at Jonas Bronck Beach.

Velasco and Muncy find Diego there, hungover, sent to swim laps to the buoys as punishment. When he struggles in a rip current, the lifeguard on duty, Frank Pinsky, hangs back, and Velasco swims out and pulls him in. Diego dies at the hospital. His former girlfriend, Daniela Cruz, says Greco raped her when Diego got her an interview, though she could barely swim, and that the Bronx precinct never followed up on her rape kit. Greco is arrested and released without bail, and Assemblywoman Diane Garcia urges Benson and Carisi to reconsider. The kit matches Greco, but Daniela backs out before the grand jury when her father’s parole officer threatens to send him back to jail.

The squad looks at the beach instead: ten people drowned there under Greco, each after a failed rescue by a lifeguard he had qualified. Ronnie Volpe, who times the tests, shows photos proving Greco changed failing scores, and the charges become depraved-indifference murder. At trial, a health department investigator and a retired chief lifeguard walk the jury through the drownings, and Volpe describes Greco’s “pay or lay” system, in which candidates qualified by giving him sex or a cut of their pay. Testifying, Greco calls lifeguards like himself the breakwater between swimmers and the sea and admits ordering Diego into the water. Pinsky then reveals that Greco told him not to go in and blackmailed him with sexual photos.

Spoiler, the ending: Confronted with Pinsky’s photos and offered a way to keep the details private, Greco pleads guilty to ten counts of manslaughter, to be served consecutively, which will keep him in prison until he is 70. Rollins, whom Fin has given a bullet like the one that hit her as a way to own her trauma, sleeps through the night for the first time in a while. Benson tells Velasco he did everything right.
