Premise: The beating death of a garment-factory owner leads to an undocumented worker whose girlfriend’s newborn turns out to be the victim’s child, and a secret surrogacy arrangement reshapes the case.

Summary

The Investigation

“Ill-Conceived” begins when two cleaners find Arnold Zachary, 55, beaten to death in his office at his nonunion garment company, A to Z Design, with his cash and jewelry untouched. Workers call him a kind, generous boss, and his 26-year-old widow points to union organizers, who say they never had a chance at the shop. A rear-door security camera caught a man in a cap marked “B.B.,” and white powder on Zachary’s jacket proves to be baking flour.

The cap leads to a bagel bakery and its part-time driver, Miguel Camacho, who flees the detectives at an off-track betting parlor because he takes them for immigration agents. He blames his bruised knuckles on a bar fight, which the bartender only partly confirms. His girlfriend, Maria Villanueva, a former worker at the factory, has just had a baby, Jose, and Zachary had been unusually kind to her. The infant’s pale skin and blue eyes make the detectives suspicious, and DNA from drool on Briscoe’s jacket shows Zachary is the father. Told that Maria will be charged and the baby handed to social services, Camacho confesses.

The Trial

Camacho is held without bail as an illegal immigrant. Defense attorney Vanessa Galiano accuses McCoy of bias for refusing a second-degree manslaughter plea, and McCoy replies that Camacho waited a week after learning the truth. Galiano moves to suppress the confession because the Miranda warnings were given only in English. When McCoy calls the warnings a hollow formality in court, Judge Grace Larkin throws the confession out.

To prove motive another way, the prosecutors trace monthly $3,000 checks from Zachary, cashed under a false name by Maria and Camacho, that began when she became pregnant. Camacho then reveals that Maria was a surrogate carrying the Zacharys’ embryo. At trial Galiano claims Zachary forced Maria into it by threatening deportation, though the fertility doctor, Dr. Harrington, says she seemed eager. Mrs. Zachary then testifies that she was able to carry a child but did not want the physical toll, a performance that seems to sour the jury on the couple.

Southerlyn suspects the testimony was a deliberate act to free Camacho and keep the baby. Mrs. Zachary reveals three miscarriages and produces a phone message in which Camacho demanded to see Zachary alone that night. Camacho finally explains that Zachary had promised help with immigration, but when Maria could not give up the baby, Zachary threatened to have them deported.

Spoiler, the ending: Camacho pleads to first-degree manslaughter and will serve 15 years before being deported. Maria and the baby are gone before police reach her apartment, and the prosecutors guess she has returned to Mexico.
