Summary
“Forty-One Witnesses” opens on the eve of Rollins’s return from eight weeks of maternity leave. Libby Parker, drunk and high on ketamine, is surrounded outside a café by three young men who take her home with her own keys; a neighbor scares them from her door, and the building’s super finds her the next morning in the courtyard, beaten, sexually assaulted and hypothermic. Neighbors admit they heard screams or saw men around her, but each assumed someone else had called the police. Her ex-husband in Detroit, who has custody of their two daughters, calls her a junkie, and Libby herself remembers almost nothing.
Carisi finds a fellow Fordham student who filmed Libby leaving the café with the three, and a youth center worker, Linda Bagley, names them as Ronnie Ellis, Juan Flores and Will Reeves. Will, once a sex-trafficking victim, is caught first and blames the others; Ronnie and Juan are run down on Atlantic Avenue after Ronnie messages Juan about a drug deal. Neighbors fumble the photo arrays, and Will’s lawyer, Henderson, tries to trade his testimony for leniency, but Barba will offer only felony assault or sexual misconduct. A brief 911 call on a phone found on Ronnie leads to Maria, a nanny in the building who saw the boys dragging Libby until Ronnie punched her, took her phone and threatened her life; she identifies all three. The defense now concedes the boys were there but claims Libby wanted rough sex and they left.
At trial, Maria cannot say she saw a rape, another neighbor admits she described the attackers only after seeing the news, and the defense gets Libby to admit she remembers nothing after taking the drug. Carisi catches Doug Nelson, a neighbor who said he was out with a boyfriend, in a lie: Libby says he is single and in her AA group. Doug admits he saw the attack, froze and got drunk instead of calling 911. He arrives at court drunk but, under Barba’s questioning, describes Ronnie and Juan forcing Libby into oral sex while Will held her down, and then proves his memory by describing the jurors with his eyes closed. Barba turns down Henderson’s last-minute offer of Will’s testimony.
Spoiler, the ending: Doug apologizes to Libby, who tells him she is sorry too, and the jury finds all three guilty of first-degree criminal sexual acts. Rollins, back from leave, doubts Libby will stay sober for long, and Benson tells a caller that she has taken her required time off and is seeing her therapist.
