Summary
“Deductible” follows Kyra Thompson, who has raised her nine-year-old brother, Jay, since their parents died and works as an assistant at AmeriWatch, a liability insurer. Her boss, Frank Bailey, has her pitch Jim Hogan, owner of the commuter helicopter company Helivate, in Hogan’s suite at the Belmore Hotel, then leaves after a call about his son’s peanut allergy. Hogan spills wine on his shirt and, once alone with her, sexually assaults her, performing oral sex on her as she tries to push him away. She locks herself in the bathroom, hitting her head as she braces the door, and stays there all night. When she does not come home, Jay walks into a precinct, and an officer brings him to Benson.
At the hospital Kyra is reluctant to talk, afraid of losing the job she needs, but flowers from Hogan thanking her for the evening change her mind, and she has a rape kit. Hogan tells Fin and Silva the encounter was mutual; Bailey tells Curry and Velasco he simply trusted her to close. Kyra, holding a $50,000 commission check that Bailey and Hogan padded, begins to doubt herself. Her kit matches Hogan, who is arrested at his helipad and claims Bailey offered her as a sweetener to close the deal and invented the allergy call. Kyra reveals that last December $2,000 in office party cash vanished from her purse, and Bailey offered to forget it if she closed this deal. A former employee, Morgan Tynes, says Bailey once threatened to send her family nude photos from her college days unless she entertained a client. Bailey is arrested for sexual coercion.
At trial Hogan, whose own charge was reduced to a misdemeanor, plays a recording of a call in which Bailey brushes off his complaint and tells him to send flowers. The defense points out that Morgan earned $65,000 in bonuses and that Kyra cashed her check, and Bailey testifies that he merely gave Kyra a chance to sell alone. Benson confronts AmeriWatch’s chief operating officer, Grace Callahan, a 20-year veteran of the firm, about shielding him. Grace then testifies that Bailey told her his plan, that she saw him take the $2,000 from Kyra’s purse, and that he used the same trick on her 20 years earlier.
Spoiler, the ending: The jury convicts Bailey on both counts of second-degree coercion, and he receives consecutive sentences. Carisi plans a separate perjury charge for Bailey’s testimony, which could bring 5 to 15 years, and Benson finds it unsettling that lying about a crime can carry more time than the crime itself.
